Yawzay Technologies Pvt. Ltd. (“Yawzay,” “we,” “us,” or “our”) takes your privacy seriously and is committed to protecting the personal information of all visitors, users, participants, subscribers, and account holders who access or use www.yawzay.com, any related web application, mobile interface, dashboard, or digital service made available by Yawzay collectively referred to as the “Platform.”

Yawzay Technologies Pvt. Ltd. may act as the digital platform operator, user onboarding facilitator, payment collection and distribution facilitator, transaction-recording platform, wallet-ledger operator, communication channel, and record-maintenance system.

Yawzay Properties Pvt. Ltd. may act as the property management entity, SPV coordinator, property administration company, development coordinator, rental management coordinator, sale coordinator, and operational manager for properties, SPVs, or property opportunities listed or managed through the Platform.

Properties or opportunities listed on the Platform may be structured through special purpose vehicles, project companies, nominee companies, holding companies, or similar legal vehicles (“SPVs”). We may process personal information in connection with such SPVs, property documentation, participant records, property management, rental distribution, sale proceeds, refunds, withdrawals, and other related activities.

2. Information We Collect

When you visit the Platform, create an account, complete KYC, submit a payment, upload payment proof, participate in a property opportunity, request a withdrawal, contact support, or otherwise use our services, we may collect information about you.

This may include:

  • Identity information, including your full name, father’s name where required, CNIC/NICOP/passport number, date of birth, nationality, gender, photographs, identity document images, selfie verification, signatures, and other identification information.
  • Contact information, including your email address, phone number, WhatsApp number, residential address, mailing address, and emergency or nominee contact details where required.
  • Account information, including username, account ID, password credentials in encrypted form, login history, account status, role, dashboard activity, preferences, and security settings.
  • KYC and compliance information, including identity verification results, AML checks, sanctions screening, politically exposed person screening, source-of-funds information, occupation, income range, tax information, bank account verification, nominee information, and other due diligence records.
  • Payment and transaction information, including deposit details, wallet entries, bank transfer information, payment reference numbers, transaction IDs, payment proof uploads, deposit slips, receipts, screenshots, payment status, refund records, payout records, withdrawal records, rental distribution records, sale proceeds records, and transaction history.
  • Bank and payout information, including account title, bank name, branch details, IBAN or account number, payment channel, withdrawal method, and payout verification details.
  • Property participation information, including opportunities viewed, participation requests, confirmed participation records, participation percentage, SPV-related records, property documents accepted, voting records, rental distribution eligibility, sale proceeds eligibility, refund eligibility, and related property-specific records.
  • Communication information, including emails, support tickets, WhatsApp messages, SMS messages, call records, chat messages, feedback, complaints, inquiries, and other communications sent to or received from us.

  • To maintain records relating to SPVs, property participation, ownership-linked documentation, rental distributions, voting, sale proceeds, refunds, and withdrawals.
  • To facilitate communication between you, Yawzay Technologies Pvt. Ltd., Yawzay Properties Pvt. Ltd., SPVs, developers, property managers, banks, payment providers, legal advisers, auditors, and other authorised parties.
  • To provide customer support and respond to your requests, complaints, disputes, or inquiries.
  • To send service notifications, account alerts, transaction updates, payment confirmations, KYC updates, legal notices, voting notices, property updates, and Platform announcements.
  • To improve the Platform, user experience, security, services, analytics, and operational performance.
  • To detect, prevent, investigate, and respond to fraud, unauthorised access, fake payment proof, identity misuse, suspicious activity, money laundering, terrorism financing, sanctions evasion, tax evasion, technical abuse, or other unlawful conduct.
  • To comply with legal, regulatory, tax, accounting, audit, corporate, banking, payment, property, KYC, AML, and record-retention obligations.
  • To enforce our Terms and Conditions, property-specific documents, payment rules, refund policy, withdrawal rules, and other Platform policies.
  • To protect the rights, property, safety, and legitimate interests of Yawzay, our users, SPVs, property partners, service providers, and other relevant parties.
  • To send marketing communications, educational content, property opportunity updates, newsletters, or promotional information where permitted by law and your communication preferences.

4. KYC, AML, and Compliance Processing

Because Yawzay deals with property participation, payments, bank transfers, wallet records, withdrawals, rental distributions, and sale-related distributions, we may be required to collect and retain additional information for compliance purposes.

You agree that we may collect, verify, process, and retain KYC, AML, identity, payment, source-of-funds, sanctions-screening, tax, and bank-verification information.

We may use third-party verification providers, banks, payment providers, legal advisers, auditors, compliance consultants, government databases where lawfully available, and other authorised parties to verify your information.

If you do not provide the required information, or if verification is incomplete, failed, suspicious, inconsistent, or legally restricted, we may delay, reject, suspend, restrict, or terminate your account, payment, participation request, withdrawal, refund, distribution, or access to the Platform.

5. Payment Proof and Transaction Records

Yawzay may require users to upload payment proof, including bank deposit slips, screenshots, receipts, transaction references, or other evidence of payment.

We may process payment proof to:

  • Match payments with Platform records.
  • Verify deposits and wallet top-ups.
  • Confirm participation requests.
  • Prevent fake, duplicate, edited, reversed, or fraudulent payment claims.
  • Maintain audit records.
  • Resolve payment disputes.
  • Comply with tax, accounting, banking, audit, KYC, AML, and legal obligations.

Payment proof may include personal information such as your name, bank account details, transaction reference, payment amount, payment date, bank name, branch information, and other details visible on the uploaded proof.

You must ensure that payment proof submitted by you is accurate, genuine, and lawfully obtained.

6. Wallet and Platform Ledger Records

The wallet shown on the Platform is a digital ledger and not a bank account.

We may collect, store, and process wallet-related information, including deposits, pending balances, locked balances, verified payments, failed payments, refunds, withdrawals, approved distributions, rental distributions, sale proceeds, admin corrections, reversal records, and transaction history.

Wallet and transaction records may be retained for legal, regulatory, accounting, tax, audit, fraud-prevention, dispute-resolution, and compliance purposes.

7. Property Participation and SPV Records

When you participate in a property opportunity, we may collect, generate, process, and retain records relating to your participation.

This may include:

  • Opportunity viewed or selected.
  • Participation amount or percentage.
  • Application Form or participation request.
  • Accepted terms and disclosures.
  • Property-specific documents.
  • SPV-related records.
  • Voting records.
  • Rental distribution records.
  • Sale proceeds records.
  • Refund and withdrawal records.
  • Communication and support history related to the opportunity.
  • Legal, tax, audit, or compliance records connected with the opportunity.

Such information may be shared with Yawzay Properties Pvt. Ltd., the relevant SPV, developers, sellers, buyers, tenants, banks, payment providers, legal advisers, auditors, tax advisers, property managers, regulators, courts, and other authorised parties where necessary or legally required.

8. Who We Share Your Information With

We may share your personal information with the following parties where necessary for the purposes described in this Privacy Policy:

  • Yawzay Technologies Pvt. Ltd., as Platform operator and payment collection/distribution facilitator.
  • Yawzay Properties Pvt. Ltd., as property management entity, SPV coordinator, rental management coordinator, sale coordinator, or property administration company.
  • SPVs or property-holding entities connected with property opportunities listed or managed through the Platform.
  • Developers, sellers, buyers, tenants, brokers, property managers, valuers, contractors, and property service providers where required for property administration, documentation, rental management, sale processing, or dispute handling.
  • Banks, payment providers, payment processors, wallet service providers, and financial service providers for payment verification, transaction processing, refunds, withdrawals, payouts, reconciliation, and fraud prevention.
  • KYC, AML, identity verification, fraud-prevention, and compliance service providers for verification and risk checks.
  • Lawyers, auditors, accountants, tax advisers, compliance advisers, consultants, and professional service providers for legal, tax, regulatory, audit, accounting, and operational purposes.

11. Calls, SMS, WhatsApp, and Other Communications

Calls, SMS messages, WhatsApp messages, emails, support chats, and other communications between you and Yawzay may be recorded, monitored, stored, or reviewed for customer service, quality assurance, training, dispute resolution, fraud prevention, legal, compliance, and security purposes.

By communicating with us through these channels, you consent to such recording, monitoring, storage, and processing where permitted by law.

12. Cookies and Tracking Technologies

We may use cookies, pixels, tags, analytics tools, advertising tools, and similar technologies when you visit or use the Platform.

Cookies may help us:

Yawzay may process payment-related information necessary to verify deposits, wallet top-ups, refunds, withdrawals, rental distributions, sale proceeds, and other transactions.

Where payments are processed through banks, payment gateways, card processors, wallet providers, or other third-party payment providers, those providers may process your payment information according to their own terms and privacy policies.

If card payments or online payment gateways are made available, we do not intend to store full card numbers, CVV codes, or sensitive card authentication data unless expressly stated and legally permitted. Such information is generally handled by authorised payment processors.

For bank transfers, manual deposits, or direct deposits, we may retain transaction references, payment proof, bank account details visible on uploaded documents, payment status, and reconciliation records for verification, audit, fraud-prevention, tax, accounting, legal, and compliance purposes.

14. Data Security

We use reasonable administrative, technical, and organisational measures to protect personal information under our control from unauthorised access, misuse, disclosure, alteration, destruction, or accidental loss.

You are responsible for keeping your password, login credentials, OTPs, devices, and account access secure. If you suspect unauthorised access to your account, you should immediately change your login details and contact Yawzay support.

Where legally required, we may notify affected users, regulators, authorities, banks, service providers, or other relevant parties about a data breach or security incident.

We may also take steps such as suspending accounts, restricting transactions, resetting credentials, preserving logs, investigating suspicious activity, or notifying law-enforcement agencies where appropriate.

18. Accuracy of Information

You are responsible for ensuring that the information you provide to Yawzay is true, accurate, complete, and up to date.

You must promptly update your account or notify us if your name, contact details, bank account, identity information, tax information, nominee information, or other relevant information changes.

Yawzay shall not be responsible for loss, delay, failed verification, failed payout, wrong communication, or other issues caused by inaccurate, outdated, incomplete, or misleading information provided by you.

19. International Transfers and Storage

Your information may be stored or processed in Pakistan or in other countries where our hosting providers, cloud service providers, communication providers, analytics providers, KYC providers, payment providers, or other service providers operate.

Where information is transferred or processed outside Pakistan, we will take reasonable steps to ensure that such information is handled in accordance with this Privacy Policy and applicable legal requirements.

20. Children’s Privacy

The Platform is not intended for children or persons who are not legally capable of entering into binding agreements.

We do not knowingly allow minors to participate in property opportunities through the Platform. If we become aware that a minor has provided personal information without lawful authority or guardian consent where required, we may delete, restrict, or suspend the relevant account and information, subject to legal and compliance requirements.

22. Business Transfers

If Yawzay, Yawzay Technologies Pvt. Ltd., Yawzay Properties Pvt. Ltd., an SPV, or any relevant part of our business is involved in a merger, acquisition, restructuring, financing, sale of assets, insolvency, transfer, or similar transaction, your information may be disclosed or transferred to the relevant buyer, successor, investor, adviser, administrator, liquidator, receiver, or other authorised party.

Any such party may use your information for the purposes described in this Privacy Policy, subject to applicable law.
